The Ukraine war, and the related sanctions, are having a severe impact on con- tracts for the carriage of goods by sea. Whilst these events can be categorized as “force majeure” and, in civil law countries like Italy, fall within the general pro- visions of contract law, a specific contractual discipline appears to be more ap- propriate to tackle the problems of defining the triggering events and allocating the consequent costs and risks. In this perspective, this article will consider the Force Majeure, War Risk and Sanctions Clauses drafted by BIMCO.
