Il travagliato processo di riforma dell’organo di autogoverno della magistratura in Polonia tra accuse di tradimento e rischi di epurazione

The reform of the National Council of the Judiciary (Krajowa Rada Sądownictwa, KRS) in Poland is the real cornerstone of reform program of the new governing coalition – composed by Civic Coalition, Third Way and New Left – to restore the independence of the judiciary and the rule of law. We will try to analyse the main issues emerged in different stages of the process which led to the approval of the reform, that has not yet entered into force. We will then evaluate the solutions adopted in the final version of the text against international and supranational standards on the independence of the judicial councils. Finally, we will try to understand the complex political and institutional problems that Poland is facing in the current phase.
