L'affaire Ferréol: esclaustrazione e dimissione del religioso davanti al giudice francese

The paper illustrates the ruling of the Court of Lorient of 13 April 2024, which condemned a French religious institute, the apostolic commissioners and the Cardinal Prefect of the Congregation of Bishops to pay compensation for the damages suffered by a nun, following her exclaustration and dismissal. We will then analyse the reasons for this ruling, also referring to the role the Court gave to the ecclesiastical authority’s failure to comply with canon law ; finally, a comparison will be made with the Italian experience.
