The present article aims at analysing the issue of constitutional limits to the re-election of the President of the Republic in Latin America, with particular attention to the cases of Bolivia and El Salvador. Specifically, it will be highlighted the fact that the Constitutional/Supreme Courts – "captured" by the political power – have assumed a real "constituent role" that does not belong to them and that, through the use of (apparently) legal arguments, have modified the contents of the same Constitutions of which they are custodians. In contexts in which (judicial) abusive constitutionalism and democratic regression overlap, it is more urgent than ever to protect Constitutions and Constitutional Courts.

Abstract
