Reflections on structural causes of discrimination - such as, for example, those on epistemic injustice and stereotyping – are increasingly underlying the need for structured institutional intervention to address this problem. On this paper, the aim is to highlight the presence of different types of barriers that women encounter in accessing justice that lead to unequal treatment. To this end, the concept of "subordiscrimination" will be addressed, as it is related to the framework proposed by "anti-subordiscriminatory" law, which aims to eradicate those cultural and legal factors that are part of a system of asymmetrical power relations. Secondly, the concept of access to justice will be clarified, with an emphasis on equality from the perspective offered by the CEDAW. Finally, the paper will focus on the barriers that victims of gender-based violence face in accessing justice both at the socio-economic and cultural level as well as at the institutional level.

Abstract

Cada vez son más frecuentes las reflexiones sobre causas estructurales de discriminación – como, por ejemplo, aquellas sobre injusticia epistémica y estereotipación – que destacan la necesidad de una intervención institucional estructurada para afrontar este problema. En este trabajo, el objetivo es identificar la presencia de diferentes tipos de barreras con las que se encuentran las mujeres en el acceso a la justicia y que conllevan un trato desigual. Con esta finalidad, se abordará primero el concepto de subordiscriminación, al estar éste relacionado con el marco de trabajo propuesto por el derecho antisubordiscriminatorio que pretende erradicar aquellos factores culturales y jurídicos que forman parte de un sistema de relaciones de poder asimétricas. Segundo, se aclarará el concepto de acceso a la justicia, haciendo hincapié en la igualdad desde la perspectiva ofrecida por la CEDAW. Por último, se hará referencia a las barreras que encuentran las víctimas de violencia de género en el acceso a la justicia tanto en el plano socioeconómico y cultural como a nivel institucional.
