Both administrative transparency and confidentiality have changed and refined their content over time. A complex relationship exists between them, made even more delicate by the current digital scenario. Balancing between transparency and confidentiality is carried out by different actors, in different locations and with different techniques. Balancing in legislation is by its very nature general and abstract, and is characterised by the wide discretion enjoyed by the legislature. Nevertheless, it must always respond to criteria of reasonableness and proportionality, monitored by the Constitutional Court. The balancing entrusted to the public administrations takes on a cascade configuration, manifesting itself through acts of self-limitation, concrete measures by the individual administrations, acts of re-examination under self-defence and rulings by the administrative judge. It is always, and in every case, a balancing activity that is not bilateral, but trilateral. Indeed, it involves, first, the interest in administrative transparency, of which all citizens are bearers, secondly, the interest (of a personal and concrete nature) of the person entitled to a right to privacy, and, at last, the public interest in the good performance of the administration, which could be hindered by excessive publicity. An articulated and not always linear overall picture and a coexistence that perpetually seeks points of balance.
Sia la trasparenza amministrativa sia la riservatezza hanno cambiato e raffinato il proprio contenuto nel corso del tempo. Tra esse esiste una complessa relazione di convivenza, resa ancora più delicata nell’attuale scenario digitale. Il bilancia- mento tra trasparenza e riservatezza avviene ad opera di soggetti diversi, in sedi distinte e con tecniche differenziate. Il bilanciamento normativo si presenta per sua natura generale e astratto, si contraddistingue per l’enorme discrezionalità di cui gode il legislatore, ma deve sempre rispondere a criteri di ragionevolezza e proporzionalità sul cui rispetto veglia la Corte costituzionale. Il bilanciamento casistico demandato alle pubbliche amministrazioni deve rispettare tutti i principi generali dell’attività amministrativa e assume una configurazione a cascata, manifestandosi attraverso atti di autolimitazione, concreti provvedimenti ad opera delle singole amministrazioni, atti di riesame in sede di autotutela e sentenze del giudice amministrativo. Si tratta sempre e in ogni caso di un bilanciamento non bilaterale, bensì trilaterale, che coinvolge l’interesse alla trasparenza amministrativa, di cui sono portatori tutti i cittadini, l’interesse, a carattere personale e concreto, del soggetto titolare di un diritto alla privacy, l’interesse pubblico al buon andamento dell’amministrazione, che potrebbe essere ostacolato da un eccesso di pubblicità. Un quadro d’insieme articolato e non sempre lineare e una convivenza alla perennemente ricerca di un equilibrio.
