Laicità giuridica e principio solidarista tra progresso spirituale della società e unità dell’ordinamento

Considering the intrinsic polysemy of the concepts of laicità and solidarity, the author aims to identify their interpretative coordinates through an integrated hermeneutics between the two eponymous principles. Emphasizing their reciprocal relationship in a democratic and pluralistic Republic, the author contends that laicità becomes clearer when viewed through the lens of solidarity, serving the mutual recognition among pluralistic actors. Similarly, if solidarity is approached from a laica perspective, it helps to understand the resilience of the legal system against the inevitable disintegrative forces of contemporary hyper-individualistic culture. The dynamics between inviolable rights and inalienable duties are built on the dialogue between laicità and solidarity. Among the duties, the one to contribute to the material and spiritual progress of society stands out, to be ful!lled in a laico way, allowing for a libertarian approach as long as the outcome is conducive to the identi!ed purpose. This gives rise to a "ow of responsible references in the theorization and practice of rights and corresponding duties, upon which the legal system will continue to evolve, laicamente and responsibly, ultimately pursuing the value of the development of the human person.
