With the Great Penal Reform, enacted in January 1975, new legal provisions came into force in the Federal Republic of Germany, regulating the commitment of offenders with diminished or absent responsibility. Since then, possible future dangerousness of the offender has been the pivotal point of placement in a forensic institution. The paper explores the development of the discussion on the dangerousness of mentally ill offenders in law and psychiatry from the 1950s to the 1990s. The focus is on the assessment of dangerousness and its further prognosis. The paper follows the path towards a paradigm shift from individual dangerousness to "calculated risk". It shows how the constitutional and social welfare arguments were challenged and put on the defensive by a change in the public safety culture.
