Dalla bilancia alla panarchia : La resilienza del e nel diritto

The essay examines the concept of resilience from a theoretical-philosophical perspective and attempts to link its history with its current use. It reflects on the ambiguity of the concept and its very broad areas of application. The aim of the essay is to analyse the metaphors embedded in the concept, their expressive power and the possible impact on legal reasoning, both at the level of the theory of legal sources and at the level of interpretative technique. In particular, in the area of legal reasoning theory, a provocation is put forward regarding the possible meaningfulness of resilience as an instrument of justice/discretionary freedom.
