The arbitrators’ independence: The point of view of the CAS arbitrator

The arbitrators’ independence and impartiality is a key issue in arbitration; it allows no different views, when examined from the point of view of the party and the arbitrator; and it is a necessity also in arbitration at the Court of Arbitration for Sport (CAS). The author underlines that the specific concerns raised with respect to the CAS system are not justified: it is obvious that CAS arbitrators must be independent and impartial, but the system in itself in which they render their services does not appear to interfere with (or prevent) the discharge of that duty.
