The prohibition of reformatio in peius, provided by all Criminal Procedure Codes of pre-unified Italy and resistant to recurring abolitionist proposals, remains marked by multiple uncertainties about its legal ground as well as application breadth. In this perspective, the paper analyses the multifaceted case law related to the question of whether, for the purposes of compliance with the principle, consideration should be given to the overall penalty imposed, as it results from the various calculation operations (synthetic criterion), or also to the different addenda that contribute to the final result (analytical criterion). In particular, the paper examines the restrictive case law regarding variation in the measure of circumstances when a change occurs in the relationship between the elements of penalty determination or in the legal qualification of the fact. Then, the paper aims to understand whether the prohibition of reformatio in peius continues to maintain its systemic consistency, as it appears in light of the latest reforms.
Previsto da tutte le codificazioni unitarie, resistente alle cicliche spinte abolizionistiche, il divieto di reformatio in peius rimane connotato da molteplici incertezze sul suo fondamento giuridico e sulla sua estensione applicativa. Il contributo, in questa prospettiva, analizza le multiformi risposte giurisprudenziali relative alla questione se, ai fini del rispetto del principio, si debba avere riguardo alla pena complessivamente inflitta, quale risulta dalle diverse operazioni di calcolo (c.d. criterio sintetico), o anche ai singoli addendi che concorrono alla determinazione del risultato finale (c.d. criterio analitico). In particolare, si considerano gli orientamenti restrittivi in punto di variazione nella misura delle circostanze quando mutino i rapporti reciproci tra gli elementi di commisurazione della pena o la qualificazione giuridica del fatto. Si intende poi sondare se la previsione del divieto di reformatio in peius continui a mantenere una sua coerenza nel sistema delle impugnazioni, per come questo si presenta anche alla luce degli ultimi interventi riformatori.
