Legal literature is increasing the attention directed towards the harmful stereotypes at different procedural stages, from pre-trial phase to sentencing. In this paper, the analysis of judicial stereotyping, as a malpractice of judicial argumentation, will focus on the court judgement. After highlighting the fundamental role of motivation as a place where judicial decisions can be monitored (2) and where judicial stereotyping can be detected (3), thispaper reflects on two types of knowledge that can convey the biases of a discriminatory culture: common sense (4) and pseudo-science (5). Although they are two types of knowledge that are used in the argumentation of the judgement in order to reach a better understanding of the facts, it is necessary that the judges adopt a critical attitude in detecting the potentially underlying discriminatory practices present in both forms of knowledge.

Abstract

In this paper, the analysis of judicial stereotyping, as a malpractice of judicial argumentation, will focus on the court judgement. La literatura jurídica está dedicando cada vez más atención a los estereotipos perjudiciales en los distintos momentos procesales, desde la fase de instrucción hasta que se dicta sentencia. En este trabajo la estereotipación judicial, como mala praxis de la argumentación judicial, se enfocará en la sentencia. Después de evidenciar el fundamental papel de la motivación como lugar donde poder ejercer un control de las decisiones judiciales (2), así como lugar donde detectar la estereotipación judicial (3), se propondrá reflexionar sobre dos tipos de conocimiento que pueden vehicular los sesgos de una cultura discriminatoria: el sentido común (4) y la pseudo-ciencia (5). Si bien son dos tipos de conocimiento que se emplean en la motivación de la sentencia para alcanzar un mejor entendimiento de los hechos, se observa la necesidad de que el órgano judicial adopte una actitud crítica para detectar la subyacente práctica discriminatoria potencialmente presente en ambas formas de conocimiento.
