This paper focuses on the cases of referral to the civil court for the decision on compensation for damages arising from a crime, during the appeals. The ones introduced by the recent Cartabia reform show their own characteristics from which uncertainties in application and system imbalances result.

Questo lavoro si concentra sulle ipotesi di rinvio al giudice civile per la decisione sul risarcimento del danno derivante da reato, nella fase delle impugnazioni. Quelle introdotte dalla recente riforma Cartabia mostrano caratteristiche proprie da cui discendono incertezze applicative e squilibri di sistema.
