Starting from the recent reforms of civil procedure in Italy, which promote and regulate its digitalisation (in order to simplify civil procedures and make them more efficient), the essay attempts to identify the indirect effects of digital transformation both at the application level and on so-called predictive justice. The investigation then extends to the impact of artificial intelligence on the justice system and to the crucial question that has long been at the core of legal philosophical thought: whether law can be translated into quantitative, computationally ascertainable elements so that it becomes (inter)objectively tangible and measurable.
Lo scritto, prendendo le mosse dai più recenti interventi del legislatore italiano sulla disciplina del processo civile che – al fine di semplificarlo e renderlo più efficiente – promuovono e regolano (in senso lato) la digitalizzazione, tenta di individuarne le indirette ricadute sul terreno sia applicativo, sia della cosiddetta giustizia predittiva. L’indagine si allarga poi al tema dell’impatto delle intelligenze artificiali sul sistema giustizia e alla questione cruciale – da tempo al centro del pensiero filosofico-giuridico – se il diritto possa essere tradotto in elementi quantitativi, suscettibili di calcolo, tali da essere (inters) oggettivamente esperibili e misurabili.
