La piccola riforma sulla tutela della salute e sicurezza del lavoro e le sue ricadute sul d.lgs. n. 81/2008

Decree Law No. 48 of 4 May 2023, converted, with amendments, by Law No. 85 of 3 July 2023, among the various areas of intervention, Capo II also deals with the protection of workers’ health and safety (Articles 14-18-bis). This is not, therefore, an organic intervention, but rather numerous micro-provisions that amend the Testo Unico directly, with others of transitional value that remain eccentric to it, with still others that affect further provisions often using the technique of novella. Although there are some appreciable innovations, on the whole, the feeling is that of a marked gap between objectives and results: on the one hand, the regulatory stock is increased; on the other hand, some regulations raise several doubts that will affect their application. Further, and far more delicate, questions remain on the table that would have deserved similar interest and appropriate solutions.

Il decreto legge 4 maggio 2023, n. 48, convertito, con modificazioni, dalla legge 3 luglio 2023, n. 85, tra i vari settori di intervento, al Capo II si occupa anche di tutela della salute e sicurezza dei lavoratori (artt.14-18-bis). Non si tratta, dunque, di un intervento organico, ma di numerose micro-disposizioni che modificano il Testo Unico in via diretta, con altre a valenza transitoria che rimangono eccentriche ad esso, con altre ancora che incidono su ulteriori provvedimenti spesso con la tecnica della novella. Pur in presenza di alcune innovazioni apprezzabili, nel complesso, la sensazione è quella di una marcata distanza tra obiettivi e risultati: da un lato, ne risulta incrementato lo stock normativo; dall’altro, alcune norme sollevano diversi dubbi che incideranno sulla loro applicazione. Sul tavolo restano comunque sospese ulteriori e, ben più, delicate questioni che avrebbero meritato analogo interesse e appropriate soluzioni.
