Italy, like many European countries, has administrative measures that limit the freedom of entry and movement of migrants and allow their immediate deportation in case of Islamist terrorist risk. The contribution analyses the applicative aspects and the criticalities of some elements of the so-called “special administrative criminal law of immigration”. These State protection measures may concern the refuse entry to a foreign national; the refusal to grant and renew the residency permit, or its revocation; the refusal to recognize refugee status; the refusal to grant citizenship and its revocation. Specifically, the administrative measures for the expulsion of foreigners ordered by the Minister of the Interior and the Prefect are very effective, although they often end up compromising some fundamental rights of the expelled foreigner.

Abstract
Italy, like many European countries, has administrative measures that limit the freedom of entry and movement of migrants and allow their immediate deportation in case of Islamist terrorist risk. The contribution analyses the applicative aspects and the criticalities of some elements of the so-called “special administrative criminal law of immigration”. These State protection measures may concern the refuse entry to a foreign national; the refusal to grant and renew the residency permit, or its revocation; the refusal to recognize refugee status; the refusal to grant citizenship and its revocation. Specifically, the administrative measures for the expulsion of foreigners ordered by the Minister of the Interior and the Prefect are very effective, although they often end up compromising some fundamental rights of the expelled foreigner.File | Dimensione | Formato | |
