The commented decision confirms that, on the basis of art. 14, paragraph 4 bis, of Law no. 537 of 1993, as amended by art. 8, paragraph 1, of the Legislative Decree no. 16 of 2012, the costs documented by subjectively non-existent invoices must be considered deductible – differently from what happens on the side of the deduction of the relative VAT – even where the taxpayer is aware of the fraud and provided that the requirements set in art. 109 TUIR are met.
La sentenza commentata conferma che, in base all’art. 14, comma 4-bis, della L. n. 537/1993, come modificato dall’art. 8, comma 1, del D.L. n. 16/2012, i costi documentati da fatture soggettivamente inesistenti debbono ritenersi deducibili – diversamente da quanto avviene sul fronte della detrazione della relativa IVA – anche laddove il contribuente sia consapevole della frode, sempre che sussistano i requisiti ordinariamente previsti dall’art. 109 TUIR.
