The essay provides a reading of the judgment under comment as a contribution to the reconstruction of a system of remedies in European regulatory private law. In particular, it is highlighted how the remedial opportunism of the protected party – in this case, brought about by the denial of a restitutory claim by the trader – constitutes one of the defining aspects of consumer protection. It is thus investigated under what conditions this is justified from the perspective of the policy objectives of the EU lawmaker. However, in conclusion, some concerns are raised about the application of this regulatory model in the market context, with regard to which the Court of Justice has expressed its opinion.
Il saggio fornisce una lettura della sentenza in commento quale contributo alla ricostruzione di un sistema dei rimedi nel diritto privato regolatorio europeo. In particolare, viene evidenziato come l’opportunismo rimediale della parte protetta – in questo caso, determinato dalla negazione di una pretesa restitutoria del professionista – costituisca uno degli aspetti caratterizzanti della tutela del consumatore. Viene così indagato a quali condizioni ciò risulti giustificato, nella prospettiva degli obiettivi di politica del diritto del legislatore europeo. In conclusione, sono però sollevate alcune perplessità sull’applicazione di questo modello regolatorio nel contesto di mercato in relazione al quale la Corte di Giustizia si è espressa.
