In particular, it dwells on the power that these boards actually have and points out how their freedom of thought can be affected by economic interests in conflict: in fact, where the foundation is connected to a gallery, it is probable that it has an interest in limiting the number of works on the market, effectively making demand prevail over supply. After underlining the difference between authentication and accreditation, the Author focuses on the contractual relationship that is established between the certifying body and the owner of the work of art, hypothesizing the potential profiles of disability and those of responsibility of the body.

La sentenza commentata è degna di nota per aver messo in luce alcune criticità legate all’operato delle fondazioni e degli archivi d’artista in sede di certificazione dell’autenticità delle opere. In particolar modo, essa si sofferma potere che di fatto hanno questi enti e rileva come la loro libertà di pensiero possa essere condizionata da interessi economici in contrasto con quelli del proprietario dell’opera: laddove infatti la fondazione sia collegata a una galleria, è probabile che essa abbia interesse a limitare il numero di opere sul mercato, rendendo di fatto prevalente la domanda sull’offerta. Dopo aver messo in luce la differenza tra autenticazione e accreditamento, l’Autrice si sofferma sul rapporto contrattuale che si instaura tra l’ente certificatore e il proprietario dell’opera d’arte, ipotizzandone i potenziali profili di invalidità e quelli di responsabilità dell’ente.
