Abstract

Following the biggest scandal in the history of art, the so-called Schwabing find, there is a burning debate about the Jewish plundering conducted by the Third Reich. Many of the treasures and works of art of those deported to concentration camps are still in private hands or in public museums illegitimately. The essay offers an insight into the historical and legal aspects of ‘restitutions’, one of the darkest chapters of the German past: behind the stolen masterpieces lies the dramatic history of those who owned and were robbed. The legal and moral problems of Gurlitt Trove are enormous and shed some dark light on the carelessness with which the work of restitution after ’45 was conducted. Some redress was achieved by punishing immoral sales because of the special nature of Holocaust claims. There was an extensive plan to plunder Jewish property as part of the final solution pursued by the Third Reich and it is still an open question today
