The A. critically comments on a recent sentence of the Cassation Court, asserting that after the term of a collective agreement has expired, and if a .s.c."ultractivity" clause is provided by the agreement (i.e., a clause providing that even after the termination, the agreement continues to produce effects until a new agreement is stipulated in its place), such a contract can be still considered as a contract fixed term contract, and does not transform into an open-ended one.
