This paper investigates whether disputes brought by individuals and associations against States to challenge environmental mitigation’s policies, the so-called climate litigation, are consistent with the fundamental structures of institutional balance and how they impact on the role of jurisdictions and on environmental protection policies. The analysis goes so far as to fear the risk that a purely individualistic connotation of the environmentalist claims may diminish the awareness of the environment as a common good, which requires protection policies, and disarticulate the rules of actions in front of the courts of law. Finally, the reflection introduces a theory to reconnect the individual and collective dimensions of the environment, based on the overlapping of legal relations and rights and the complexity of contents and dimensions of sustainability, which implies a process of a properly political nature.
Questo scritto si domanda se le liti strategiche in materia ambientale e, in particolare, quelle che riguardano le controversie intentate da individui e associazioni contro gli Stati per contestare le politiche di mitigazione, che si ascrivono nella categoria del cosiddetto contenzioso climatico, siano coerenti con le strutture fondamentali del nostro ordinamento e si interroga, in chiave critica, sul come impattino sul ruolo della giurisdizione e sulle politiche di protezione dell’ambiente. L’analisi giunge a paventare il rischio che una connotazione schiettamente soggettiva della rivendicazione ambientalista diminuisca la consapevolezza dell’ambiente come patrimonio comune, che necessita di politiche di protezione, e disarticoli il sistema della tutela processuale, confondendone presupposti e funzioni. Infine, la riflessione propone una ricomposizione tra dimensione individuale e collettiva dell’ambiente, basata sulla sovrapposizione di relazioni giuridiche e situazioni soggettive, sulla complessità di contenuti e dimensioni della sostenibilità, che necessita un’analisi di carattere propriamente politico.
