The author considers the arguments put forward by Mommsen to maintain that in the fifth and fourth centuries BC. the citizens of the various cities linked together by the foedus Cassianum would have had the right to obtain citizenship from any other populus of the confederation, simply by transferring their domicile there (so-called ius migrandi). It appears that Mommsen, differentiating himself from Niebuhr, founded his thesis on a particular configuration of the archaic exile, on the ancient institution of applicatio and on an alleged sharing by the Latins of some rules of hereditary law. None of these arguments appear convincing. The evidence of the existence of the ius migrandi of the Latins for the archaic age seems to be lacking.
Si considerano gli argomenti posti da Mommsen alla base della sua teoria, secondo la quale nel V e nel IV secolo a.C. i cittadini delle varie città legate tra loro dal foedus Cassianum avrebbero avuto il diritto di conseguire la cittadinanza presso qualsiasi altro populus della confederazione, semplicemente trasferendovi il proprio domicilio (c.d. ius migrandi). Risulta che Mommsen, differenziandosi da Niebuhr, abbia fondato la sua tesi su una particolare configurazione dell’arcaico esilio, sull’antico istituto dell’applicatio e su una presunta condivisione, da parte dei Latini, di alcune norme del diritto ereditario. Nessuno di tali argomenti appare convincente. Le prove dell’esistenza del ius migrandi dei Latini per l’età arcaica sembrano difettare.
