In the Antiquitates Romanae, Dionysius of Halicarnassus used the term isopoliteia to describe the relationship between Romans and Latins after the foedus Cassianum (493 a.C.). The modern historian Barthold Georg Niebuhr (1776-1831) explained the meaning of isopoliteia in Dionysius’ work based on comparison with the meaning that the term had had in the treaties between the poleis of the Hellenistic age. Building on the results achieved, Niebuhr developed a theory, according to which Romans and Latins enjoyed a mutual ius migrandi. In this essay, the theory of Niebuhr (which greatly influenced the subsequent doctrine) is subjected to a critical examination and it is denied that in the fifth century B.C. the so-called ius migrandi ever existed between Romans and Latins.
Nelle Antiquitates Romanae, Dionigi di Alicarnasso impiegò il termine isopoliteia per riferirsi ai rapporti esistenti tra Romani e Latini nel periodo successivo al foedus Cassianum (493 a.C.). Lo storico moderno Barthold Georg Niebuhr (1776-1831) spiegò il significato di isopoliteia nell’opinione di Dionigi sulla base del confronto con il significato che il termine aveva avuto nei trattati tra le poleis di età ellenistica. Dai risultati che trasse da tale confronto, Niebuhr sviluppò una teoria, secondo la quale Romani e Latini dall’inizio del quinto secolo a.C. godevano di un reciproco ius migrandi. In questo contributo si sottopone a esame critico la teoria di Niebuhr (che influenzò molto la seriore dottrina) e si nega che nel quinto secolo a.C. sia mai esistito il c.d. ius migrandi tra Romani e Latini.
