Alla luce del dubbio: La razionalità giuridica tra scetticismo e artificio

Not all doubts are equal. Leaving aside the case of pathological uncertainty, here we distinguish in particular the hypothesis of methodological doubt, that is, the doubt instrumental to development of a research program, and the hypothesis of philosophical doubt, where the same questions always resurface. We want moreover to defend legal enlightenment from nihilistic tendencies. Actually, the old certainties, or "dogmas", on which legal doctrine rested, have collapsed. Nor can doubts be resolved by resorting to a hidden wisdom. On the contrary, to make the law capable of being known, or better publicly determined, we need formal standards and shared procedures. Such mechanisms are the ground on which depends the possibility of constitutional control and the implementation of the rule of law.
