In its advisory opinion of 25 February 2019 on the Legal Consequences of the Separation of the Chagos Archipelago from Mauritius in 1965, the International Court of Justice addressed (and dismissed) an objection raised by the United Kingdom and other participants, based on the existence of a bilateral dispute between the United Kingdom and Mauritius. The present article investigates the reasons for this decision, and the potential limits that the existence of a bilateral dispute may impose on the scope of the Court’s pronouncement.
