This article focuses on the irregular immigrants’ rights. The article states that the foundation for the attribution of fundamental rights to all immigrants originates from the constitutional principles contained in the Italian Constitution and, from a comparative point of view, in the Spanish Constitution too. This system of protection of fundamental rights is strengthened by its interaction with the international and European system of human rights protection. The article examines the measures against irregular immigration adopted by the European Union in the field of the new common immigration policy and shows some problematic aspects of this intervention from the point of view of fundamental rights respect. Finally, an analysis of the legislative acts adopted in Italy against illegal immigration stresses some problematic aspects in the field of fundamental rights respect.

Abstract
