The Italian Supreme Court established that the tax authorities cannot suspend a VAT refund due to unpaid tax debts if the taxpayer has provided a guarantee under Art. 38-bis of Presidential Decree No. 633/1972. The Court’s decision is based on the principles of cooperation and good faith (Art. 10 of the Italian Taxpayers’ Charter) and the principles of economic and social solidarity (Art. 2 of the Italian Constitution). The judges’ reasoning can be read as an implicit application of the principle of proportionality in administrative action to the case in question.
Le sezioni unite hanno stabilito che, se il contribuente ha prestato garanzia ai sensi dell’art. 38-bis del d.p.r. 633/1972, il rimborso del credito IVA non può essere sospeso attraverso un provvedimento di fermo amministrativo. La Corte raggiunge questo risultato interpretativo basandosi sui principi di collaborazione e buona fede (art. 10 Statuto) e di solidarietà economica e sociale (art. 2 Cost.). Il ragionamento dei giudici può essere letto come un’implicita applicazione al caso di specie del principio di proporzionalità dell’azione amministrativa.
