The “Marasco case”: when keeping the patient alive is overtreatment The paper aims to provide the background necessary to understand the judicial and media events concerning a case of overtreatment practiced by doctors on a child of a few months suffering from a very serious syndrome that left no life expectancy. The paper also analyses the recent decision of the Court of Bari, Section II, February 14, 2019, no. 667, which recognized the right of the child's parents, iure proprio and iure hereditatis, to compensation for the biological damage suffered.
Il Caso Marasco: quando mantenere in vita “ad ogni costo” configura un’oggettiva forma di accanimento terapeutico Si fornisce una ricostruzione storico-sociale e teorica del caso Marasco al fine di dare una contestualizzazione delle vicende giudiziarie di cui si presentano i documenti e le memorie. Davide Marasco era neonato affetto da una sindrome gravissima che non lasciava speranze di vita e su cui è stato praticato accanimento terapeutico. Oltre a presentare il contesto sociale e i problemi teorici, attenzione è dedicata alla (poco nota) sentenza del Tribunale di Bari (14 febbraio 2019) che ha riconosciuto ai genitori del bambino al risarcimento del danno biologico subìto.
