Die Einwirkung vom EU Recht auf die italienische Verfassung

European integration affects Italian constitutional law in many ways, as do all the constitutions of the Member States. On the one hand, this is done through the action of the legal system of the Council of Europe, which brings together 47 countries and in particular provides for the protection of human rights and international instruments and means to create such protection. On the other hand, 27 states (as a result of Brexit) are part of the European Union. As is well-known, the impact of the EU overlaps in part with the influence of the Council of Europe because the EU Court of Justice applies the principles of the European Convention on Human Rights as general principles of EU law. The paper therefore aims, in particular, analyse the impact of EU law on the Italian Constitution

L'integrazione europea influisce in molti modi sul diritto costituzionale italiano, così come tutte le costituzioni degli Stati membri. Da un lato, ciò avviene attraverso l'azione dell'ordinamento giuridico del Consiglio d'Europa, che riunisce 47 paesi e in particolare prevede la tutela dei diritti umani e strumenti e mezzi internazionali per creare tale protezione. D'altro canto, 27 Stati (come conseguenza della Brexit) fanno parte dell'Unione europea. Come è noto, l'impatto dell'UE si sovrappone in parte all'influenza del Consiglio d'Europa perché la Corte di giustizia UE applica i principi della Convenzione europea dei diritti dell'uomo in quanto principi generali del diritto comunitario. Lo scritto si occupa dunque, in particolare, di analizzare l'impatto del diritto UE sulla Costituzione italiana.
