The struggle for the affirmation of copyright in Italy was slow and bristled with difficulties. While the 18th century represents a milestone in the British and French world, since after a long and troubled debate, the authors’ copyright and literary property were finally acknowledged (already in 1710 in England and in 1793 in France), the situation was far different in the Italian historic states. Namely, literary propriety appeared in Italy only after the Napoleonic era and limited to the Cisalpine Republic. Nevertheless, the author’s name remained ignored even on the title page of successful literary genres, such as novels, science popularisation, travel literature. The recourse to anonymity was widespread, and not only due to censorship. Such negation of intellectual responsibility can be defined as a “functional ambiguity”, borrowing a definition used to analyse the freedom of press in the English context: the result of a complicated balance between censorship and public opinion. In a similar way, the ambiguity of a concealed or fake intellectual responsibility allows flexibility and adaptation depending on the context.
Lento e irto di ostacoli fu il percorso che portò all’affermazione del diritto d’autore in Italia. Se per il mondo inglese e francese il XVIII secolo rappresenta il momento in cui gli autori, dopo un lungo e travagliato dibattito, vedono riconosciuta la proprietà letteraria (sin dal 1710 Settecento in Inghilterra e dal 1793 in Francia), negli Stati italiani d’Antico Regime, la situazione è ben diversa. Bisogna attendere la stagione napoleonica affinché il diritto di proprietà letteraria faccia ingresso in Italia, e in ogni caso esso vale soltanto per i territori della Repubblica cisalpina. Il nome dell’autore non si fa strada neppure sul frontespizio dei generi editoriali di grande successo (romanzi, libri di divulgazione, libri di viaggio): ampio appare infatti il ricorso all’anonimato, e non solo per motivi di censura. Si potrebbe definire questa negazione della responsabilità intellettuale come «un’ambiguità funzionale», usando la stessa categoria con cui alcuni studiosi hanno analizzato, per il caso inglese, il concetto di «libertà di stampa», sottolineando quanto essa fosse il frutto di un equilibrio complesso tra censura e opinione pubblica. L’ambiguità, anche nel caso della responsabilità intellettuale taciuta o falsificata, consente flessibilità e adattamento a seconda dei contesti.
