Brexit e cittadinanza europea

Brexit, that is the withdrawal of the United Kingdom from the European Union, will affect the European citizenship and will deprive UK nationals living in the other 27 Member States and nationals of the other 27 Member States living in the UK of the security of residence they at present draw from EU law. It is of paramount importance that the withdrawal agreement, which is under negotiation between the parties, safeguards the residence rights of those people. The negotiators reached a provisional agreement on the subject on December 2017. A first draft of the Withdrawal Agreement has been released in March 2018. The present paper analyzes the documents embodying the agreement, in order to highlight their main shortfalls.

La Brexit, ossia il recesso del Regno Unito dall’Unione europea, produrrà effetti sulla cittadinanza dell’Unione. In particolare, priverà i cittadini del Regno Unito che vivono negli altri 27 Stati membri e i cittadini dei 27 Stati membri che vivono nel Regno Unito della sicurezza della residenza che il diritto dell’Unione assicura loro. L’accordo di recesso dovrà salvaguardare tali diritti. Regno Unito e Unione europea hanno raggiunto un accordo di massima sul punto, confluito in un Joint report e in una Joint technical note, pubblicati l’8 dicembre 2017, e poi trasfuso in una bozza di accordo di recesso. Il presente contributo analizza le soluzioni cui le parti sono giunte, mettendone in luce i punti deboli e le lacune.
