The main goal of this paper is to give a general overview of the practical implications of the asylum system in UK, trough an empirical research. I will start from an analysis of the International legislation, concerning the right of asylum, in order to show its reflexes in the English legislation and the practical implementation of these two systems. First I will look to the U.N. Geneva Convention regarding the status of refugees, but also at the Dir. 2001/55 CE and Dir. 2003/9/CE and the s.c. New Directive on Procedures of 2005. Furthermore, I will introduce the English legislation especially taking in account the Asylum and Immigration Appeals of 1996, 1999, 2000 and the more recent modifications of 2002, 2004, 2006, after 9/11, which shows a more and more strict evolution of the policies in the field and which arises a lot of human rights issues. The aim of this investigation is remark the difficulties that this regulation creates to the asylum’s seekers and the practical application of this law itself. This analysis of the legislation will be followed by an empirical research trough some English Courts decisions and some interviews to refugees. I will analyse the situation of the Sudanese refugees from the Darfur’s Civil war, in UK. I will also link these data and their results trough a theoretical prospective, investigating about the function of a law that is not truly applied.
