Decentramento territoriale e regionalismo francese : origini, evoluzione e recenti sviluppi: dottorato di ricerca in diritto costituzionale

The doctorate thesis is divided in three parts. Two chapters compose the first part. The first chapter deals with the study of the sources of French regionalism, especially with an historical and ideological approach. The second chapter develops the subject of the bills in regional field introduced during the third, the fourth and the fifth Republic. In this respect, a considerable role is played by the project of the regional reform project dated April 1969 and written by Charles De Gaulle. Also the second part is dived in two chapters and is dedicated to the administrative organization, to the regional powers and to the financial and accounting regional structure. More specifically, the purpose is to compare one to each other the Law 5th July 1972, n. 72-619 and by the Law 2nd March 1982, n. 82 – 213, providing for the organization, the regional powers and the tax resources of these institutions. The final result is an analysis of the new difference legal rules originated by the transformation from “local government” to “territorial community”. At last, the sixth chapter handles with a deductive method the recently rules, which introduced in France the devolution. The analysis develops from the fundamental principles grounding the French devolution grounding the devolution itself. Later, the thesis draw more specifically the reform of the constitutional Law n. 2003 – 276 dated 28th March 2003, under every respect. A particular examination regards the features of the reform about the relationships between the territorial communities (and also of the overseas communities), the devolution, the institutional evolution of Corsica, the testing of new legal rules in this field, the regional powers, the reform of the financial autonomy of the French regions and, at last, the role now played by this territorial community in Europe.
