The book provides an introductory discussion of antitrust damages, mainly from a European perspective. Written by economists, it provides an integrated discussion of the major economic and legal issues, while avoiding formal analysis throughout. After an introductory review of antitrust damages, the second section of the book discusses how proof of damages may be constructed in cartels and abusive behaviour cases. Passing-on issues are discussed in the light of the relevant rulings of the European Court of Justice, and of the decisions of several civil courts in EU countries. The discussion of article 82 cases devotes some space to the issue of mitigation, which is far from being settled in Europe. Section 3 provides a detailed discussion of the major techniques for damage estimation in antitrust cases. Before and after, yardstick, and analytical methods are discussed in an easily accessible way, with ample reference to cases litigated in a number of European countries. Where appropriate, extensive discussion is provided of US cases. Section 4 concludes the book with a detailed discussion of the proposals contained in the European Commission''s 2008 White Book, conducted in the light of a thorough examination of the comments received by the Commission. Class action issues arising both from the Commission''s proposals, and from recent changes in Italian law, are also analyzed.
