This study on the preliminary draft of the European Contract Code drafted by the international group of jurists, which became the Academy of European Private Lawyers centred in Pavia, originates from the Communication 11.7.2001 "on European contract law" of the European Commission. Expressly mentioned by this Communication, the text of the Pavia group reflects one of the possible options envisaged by the Commission in the prospect of a future harmonization of contract law in Europe. What is involved is a draft for a new and exaustive legislation contained in a corpus of authentic rules (and not of principles). The draft is the outcome of an approach to the matter which is problem-based rather than mainly theoretical and is marked by the refusal to compromise when faced with different solutions emerging from various national laws and consequently by a series of clear choices.
