L'emergenza sanitaria e i diritti dimenticati

The article analyzes the legislative measures enacted during the emergency situation from the standpoint of the sources of law and of their impact on already discriminated or vulnerable people. From a general viewpoint, these measures pose several criticisms in terms of their compliance with the rule of law and with the Constitutional Court’s case-law on emergency. Moreover, these legislative measures proved not to take the status of already discriminated people into proper account, at least in the early stage of intervention. The study focuses on the impact of these measures on women, people with disabilities, migrants, detainees. The article ends with an analysis of the problems related to the Italian “recovery plan”, through the examination of some important documents presented by the task force “Colao” and the Government.
