The Author analyses some of the provisions regulating the judicial liquidation provided by the Insolvency Code. The attention is focalized, first of all, on the procedure applicable in case a creditor has a mortgage on the estate of the insolvent in guarantee of a credit towards a third party; secondly on issues related to the effect of the decree that approves the statement of liabilities; lastly, on the new discipline of the challenge of such decree.
