Here we analyze judgment n. 263 of 2019, with which the Constitutional Court intervened, for the first time, on the new juvenile penitentiary system, declaring the constitutional illegitimacy of the provision which automatically deny access to community criminal measures and other benefits to those who have been convicted of specific and serious criminal offences as juveniles (so-called crimes “without parole”), thus allowing the supervisory court to provide an individualized assessment for all juvenile offenders, without the type of offense being of any relevance.
Si analizza la decisione n. 263 del 2019, con cui la Corte costituzionale è intervenuta, per la prima volta, in relazione al nuovo ordinamento penitenziario minorile, dichiarando illegittima la disposizione che impedisce automaticamente ai condannati, che abbiano commesso nella minore età alcuni specifici e gravi delitti (c.d. reati ostativi), l’accesso alle misure penali di comunità e agli altri benefici, consentendo così al tribunale di sorveglianza una valutazione individualizzata per tutti gli autori di reato minorenni, senza che assuma rilevanza il tipo di reato commesso.
