On the basis of the Court’s case-law relating to the non-application of the Treaty rules governing the free movement of persons in purely internal situations, the A. gives priority to the criterion that the EU Law (in particular the freedoms of movement guaranteed by primary EU law) must be interpreted as being applicable where the internal legislation an abstract is capable of producing effects which are not confined to that Member State. This approach follows from the need to ensure the effectiveness of EU Law and especially of the principle of full ‘judicial protection’ for the rights which individuals derive from EU law.
