This paper offers a comprehensive analytical framework of how business in-novation can create policy disruption and how regulators should respond. In particular it describes the case of the Uber platform because its advent has been a disruptive element in the taxi’s industries. In fact historically technology played little role in the taxi’s industry and the taxi service is subject to barriers to entry created by regulation. In the second part the paper analyses the recent case of the CJEU (decided on 20 december 2017) concerning the application Uberpop In this case the Court stated that Uber was not a mere intermediary service provider but a provider of transport service. The new legal test applied by the Court to reach its conclusion are likely to have repercussion beyond the transport sector.
