Comparative labor law used to look primarily at the set of rules governing labor law institutions in the other Countries. Still, the development of the “platform economy” on a global scale has recently prompted scholars to place a significant weight upon – not only the foreign policies, but also and foremost – the Courts’ rulings regarding the classification of “gig workers” (such as Uber drivers, Foodora and Deliveroo riders, etc.) in the different Jurisdictions. In view of the above, the A. scrutinizes the grounds of the latter decisions with the aim of reflecting on both the potential and the limit of such a comparative effort by those who are in charge of the interpretation of the Domestic laws.
Se la comparazione guarda tradizionalmente, anche in ambito lavoristico, alle regole vigenti negli altri ordinamenti, di recente è emersa una chiara tendenza, favorita dalla convergenza a livello globale nelle modalità di lavoro proprie della c.d. economia delle piattaforme, a porre a confronto – non già gli istituti o le norme, bensì – le decisioni che, nelle diverse giurisdizioni, hanno riguardato la qualificazione dei c.d. “gig workers”, tra cui gli autisti di Uber e i riders di Foodora, Deliveroo, ecc.L’elaborato ripercorre le trame degli arresti più significativi intervenuti in materia, calandoli nel relativo contesto ordinamentale, allo scopo di riflettere sulle potenzialità e, soprattutto, sui limiti di un simile sforzo comparativo da parte degli interpreti nazionali.
