The Italian legislation on public domaine is in transition. The old model has been mostly imported from France and was shaped in analogy with the right of private property. This analogy is misleading, and the paradigm of private property must be abandoned. Nevertheless a guideline must be retained: the administration of public assets must be entrusted to a legal entity in order to avoid the tragedy of the commons and the tragedy of anticommon as well.
