This book is the first output of our teaching experience in the context of the Jean Monnet module “Regulatory Networks and European Governance”. It collects the materials developed and used by the students in this three-year period. An ongoing exchange between the students and us has produced this final improved version. Our book is organized in two parts. The first opens with a look at the foundation of European public law also through the Court of Justice’s decisions and highlights the principal matters of integration between European law and national orders, especially the Italian one. However essentially it provides some basic elements on significant topics to deal with the Agencies and their activities in many and different fields. Consequently Chapter 3 of this part summarizes the most important legal principles referring to the administrative procedures as well as the necessary forms of protection of individual rights. In such a context the constitutive elements of regulatory procedures carried out by Agencies and Authorities at both European and national level are emphasized. The second part includes a general frame regarding the different typologies of Agencies at European level through a basic distinction between “executive Agencies” and “regulatory Agencies”. Two different models of Agencies have been brought within the latter: on the one hand, the Agencies involving mostly regulatory activities based on expertise and information; on the other hand the Agencies more recently established which result from an evolution of the model of “regulatory network” into the new “networked Agency”. The emergence of the networked agencies represents a new step in sectoral regulation. The “re-framing” of the regulatory networks as network agencies moves towards fostering closer regulatory convergence. This recent model characterizes several different areas: not only energy (Agency for the Cooperation of Energy Regulators) and telecommunications (Body of European Regulators for Electronic Communications) markets but also the financial markets after the reform of financial supervision (European Securities and Markets Authority; European Banking Authority; European Insurance and Occupational Pensions Authority).
